Lion's Gate is "stalking horse" bid for T franchise

I didn't see anything about this here already...It appears Lion's Gate is VERY interested in the Terminator franchise. They're the "stalking horse" bid, which apparently is kind of like an opening bid. http://latimesblogs.latimes.com/entertainmentnewsbuzz/2010/01/lions-gates-15-millionplus-offer-for-terminator-now-the-bid-to-beat.html "The designation of stalking horse means any other company that wants to bid against Lions Gate has to offer at least $500,000 more" The Miami Herald reports that these are the other interested parties: http://www.miamiherald.com/entertainment/movies/AP/story/1424017.html "Sony Pictures, which distributed "Salvation" overseas; Warner Bros., which distributed the movie domestically; Summit Entertainment, the independent studio behind the "Twilight" movies, and film financing and production company Legendary Pictures are all considering making bids, according to people close to the companies." I'm reserving judgement on whether this is good or bad for TSCC. I guess we're going to start hearing more news on this soon. Do you find this valuable?

Thanks for finding and posting that. It's good to see someone is still out there keeping up with this. I would expect that someone is going to come in with a higher bid since 15 mil seems kind of on the low end.

Probably, but from some of the other stuff I read, it's a pretty good thing to be the stalking horse bid. There are other advantages that impact if others choose to bid. The $15 million in cash seems low but the 5% of gross receipts from any future Terminator movies could end up being more substantial than expected. So at second glance, that does sweeten the bid. It seems, in this case, that the stalking horse provision calls for any other party to out bid Lion's Gate by half a mil, but I don't see anything in the articles about any additional penalties for other bids. Assuming that's the only provision, I think that gives Lion's Gate the option to out bid competition in small increments where as competing bids have to out bid by $500,000. I'm guessing on that but Lion's Gate at least gets an initial bidding advantage. In this situation, it seems that Halcyon will not be penalized by competing bids. I don't think that will stop other bidding if one of the other companies really wants it. The second article seems to think that competition for the rights is going to "heat up". I have no idea either way whether anyone else wants it that bad, but I expect that WB and/or Sony will try for a bid.At any rate, the bidding deadline is Feb 5 and the new owners will be decided on Feb 10. So, according to that article, we should know who the new owners are in less than a month. Do you find this valuable? |

If you're a TSCC fan, you probably want WB to win the bidding. They own some portion of the TSCC rights and Halcyon owns the rest. They also distributed the movie domestically as the article says. But if they acquire these rights, they'll own most everything. If you think about it, that would make it "more likely" that the whole franchise will be merged with TSCC or even redirected along TSCC lines, unless they would just want to throw out TSCC all together which I don't expect they do. They certainly wouldn't try and buy it unless they wanted to do something with it. It's not like they are going to make a lot of money on what's left of the franchise right now. But you never know what the other companies want to do either, they may want to bring back TSCC as well or throw it out completely. I'm just considering the odds at this point. But it should be interesting to see how this turns out.
